SMS Terms and Conditions

These SMS Terms and Conditions govern multi-factor authentication, one-time passcode, login verification, identity verification, password reset, and other account-security text messages provided by Dealer365 Inc. through the Dealer365 service.

1. Acceptance of Terms

By enrolling a mobile phone number in the Dealer365 SMS authentication program, requesting a verification code, or otherwise using the SMS program, you agree to these SMS Terms and Conditions and our Privacy Policy.

These terms apply specifically to SMS and MMS communications sent for Dealer365 authentication and account-security purposes. Additional terms may govern the underlying Dealer365 application or services provided by your organization.

2. Program Description

Dealer365 may send automated transactional text messages to a mobile number that a user has registered for account security. Messages may include:

3. Eligibility

You must be authorized to use the Dealer365 account and mobile number being enrolled. You represent that you are the subscriber or customary user of the mobile number provided, or that you have permission from the subscriber to use the number for authentication.

You must promptly update your account if the mobile number changes, is reassigned, is disconnected, or is no longer under your control.

4. Enrollment and Consent

Users enroll by entering a mobile phone number during account registration or in account-security settings, selecting SMS as an authentication method, reviewing the applicable disclosure, and actively requesting a verification code. The SMS option is not preselected where alternative authentication methods are available.

By selecting SMS verification, you authorize Dealer365 and its messaging service providers to send automated account-security text messages to the number provided. Consent to receive SMS messages is not a condition of purchasing goods or services. Where offered, you may choose another authentication method, such as email verification or an authenticator application.

Consent applies only to this security program. Enrollment in the MFA SMS program does not constitute consent to receive marketing or promotional text messages.

5. Message Frequency and Charges

Message frequency varies and depends on user-initiated login, verification, recovery, and account-security activity. You may receive more than one message when additional verification or security notification is required.

Message and data rates may apply. Your wireless carrier determines the charges associated with text messages and data usage. Dealer365 does not charge a separate fee solely for participating in the SMS authentication program.

6. Opt-Out and Help

Opting out

Reply STOP to a Dealer365 text message to stop SMS messages. We may send one final confirmation message acknowledging your opt-out request. After opting out, you will no longer receive authentication or account-security messages through SMS unless you enroll again.

Opting out of SMS may prevent you from using SMS as an authentication method. You may need to configure another available authentication method to access protected account features.

7. User Responsibilities

You agree to:

Dealer365 personnel and support providers will not ask you to disclose a one-time passcode through an unsolicited call, email, or text message.

8. Message Delivery and Availability

Message delivery depends on mobile carrier networks, device availability, coverage, service status, and other factors outside our control. Delivery may be delayed or unsuccessful. SMS should not be treated as the sole means of receiving time-critical emergency communications.

Participating carriers may change. Carriers are not responsible for delayed or undelivered messages. Dealer365 may modify supported countries, carriers, phone-number types, or authentication methods for security, technical, legal, or operational reasons.

9. Privacy

Our collection and use of mobile information, SMS consent records, authentication events, and message-delivery information are described in the Dealer365 Privacy Policy.

We do not share, sell, rent, or provide your mobile phone number, SMS opt-in information, or messaging consent data to third parties or affiliates for marketing or promotional purposes. Limited information may be provided to telecommunications carriers and contracted service providers only as necessary to transmit, secure, troubleshoot, and support requested messages.

10. Acceptable Use

You may not use the SMS program to attempt unauthorized access, bypass security controls, impersonate another user, interfere with service operation, test stolen credentials, or engage in fraudulent or unlawful activity.

We may use automated safeguards, rate limits, fraud detection, and verification controls to protect users and the service.

11. Suspension and Termination

We may suspend, restrict, or terminate SMS authentication when reasonably necessary to protect an account, investigate suspected abuse, comply with law or carrier requirements, address security risks, or maintain service integrity.

You may discontinue SMS authentication by replying STOP, removing the mobile number from account-security settings, selecting another authentication method, or closing the applicable account, subject to your organization’s account-management rules.

12. Disclaimers and Limitation of Liability

The SMS program is provided on an “as available” basis. To the extent permitted by applicable law, Dealer365 does not guarantee uninterrupted, timely, or error-free message delivery.

To the extent permitted by applicable law, Dealer365 Inc. and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from delayed, failed, or unauthorized SMS delivery; loss of device or number control; carrier outages; or a user’s disclosure of an authentication code.

Nothing in these terms excludes liability that cannot lawfully be excluded or limited.

13. Changes to These Terms

We may update these terms to reflect changes in the SMS program, authentication methods, carrier requirements, security practices, or applicable law. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the SMS program after an update constitutes acceptance of the revised terms to the extent permitted by law.
